Maddox Gallery is committed to making its website and digital content accessible and user-friendly, including for disabled people and people who use assistive technologies. In addition, Maddox Gallery is committed to complying with all applicable English law legislation and regulations governing the sale of artwork, the provision of advisory services on artwork sales, and the operation of its business. This policy sets out the key obligations and commitments of Maddox Gallery under the relevant legislative and regulatory frameworks.

1. Scope of this policy

This policy applies to the Maddox Gallery website at www.maddoxgallery.com, the main website content, features and journeys available through it (including browsing, enquiries, account areas, forms, events, checkout and payment journeys), and to the business activities of Maddox Gallery, including the sale of artwork, the provision of advisory services on artwork sales, and all related client-facing and operational activities. 

Some third-party content, embedded tools or external platforms may be outside our direct control. Where Maddox Gallery engages third-party service providers, it will take reasonable steps to ensure that those providers comply with relevant legal and regulatory requirements.

In respect of its website and digital content, Maddox Gallery aims to meet the Web Content Accessibility Guidelines (WCAG) 2.2 Level AA, which explain how to make web content more accessible for disabled people and more usable for everyone. By using our website, you confirm that you accept these terms and that you agree to comply with them. If you do not agree to these terms, you must not use our site

We are working towards achieving conformance with WCAG 2.2 Level AA. 

We have not yet completed a full independent accessibility audit of all website pages, features and third-party integrations, so we do not currently claim that the website is fully compliant.

We are working to improve the accessibility of our website by reviewing website templates, content, user journeys, forms, account areas, checkout journeys and third-party tools against accessibility best practice and by reviewing the accessibility of our client-facing services. We do not guarantee that our website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our website for business and operational reasons. 9. Anti-money laundering (AML)

Maddox Gallery is an art market participant within the meaning of the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 (as amended) (the “MLR 2017”). As such, Maddox Gallery is subject to AML obligations when it acts as an intermediary in the sale of works of art or when it carries out transactions or a series of ‘linked transactions’ (whether the transaction is carried out in a single operation or in several operations which appear to be linked).

Maddox Gallery will maintain and implement appropriate policies, controls, and procedures to mitigate and manage the risks of money laundering and terrorist financing, including carrying out risk assessments, applying customer due diligence measures (including identification and verification of clients), maintaining adequate records, and reporting suspicious activity to the National Crime Agency. Maddox Gallery will register with HMRC as a supervised art market participant and will comply with all applicable HMRC guidance on AML for art market participants.

11. Intellectual property

We are the owner or the licensee of all intellectual property rights in our website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. 

Our status (and that of any identified contributors) as the authors of content on our website must always be acknowledged (except where the content is user-generated).

You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors. 

Maddox Gallery acknowledges and respects the intellectual property rights of artists, creators, and other rights holders. All artwork sold, exhibited, or featured by Maddox Gallery is handled in accordance with the Copyright, Designs and Patents Act 1988 (“CDPA 1988”). Maddox Gallery will not reproduce, distribute, communicate to the public, or make available any artwork or related content in a manner that infringes the copyright of the rights holder, unless authorised by the rights holder or permitted by a statutory exception. 

In accordance with the Artist’s Resale Right Regulations 2006 (implementing Directive 2001/84/EC), Maddox Gallery will, where applicable, ensure that the artist’s resale right (droit de suite) is respected on qualifying sales of original works of art and copies made by or under the authority of the artist. Maddox Gallery will take all reasonable steps to identify where the resale right applies, to calculate the royalty due, and to ensure that the royalty is paid to the artist or the artist’s collecting society. The resale right applies to sales involving art market professionals where the sale price is 1,000 euros (€) or more.

Where Maddox Gallery provides advisory services involving the assessment of artwork, provenance research, or valuation, it will take reasonable care to ensure that any intellectual property issues (including copyright ownership, licensing, and moral rights under the CDPA 1988) are identified and communicated to the client. 

12. Financial services regulation

Maddox Gallery’s advisory services are limited to advice on artistic merit, provenance, market trends, and the suitability of artwork for purchase. Maddox Gallery does not provide investment advice, financial advice, or advice on the acquisition of artwork as an investment. Where a transaction or advisory engagement may involve activity that falls within the regulatory perimeter of the Financial Conduct Authority (“FCA”), Maddox Gallery will refer the client to an appropriately authorised person.

13. Trading standards and advertising

Maddox Gallery complies with the Consumer Protection from Unfair Trading Regulations 2008 (the “CPRs 2008”). Maddox Gallery will not engage in any commercial practice that is unfair, misleading, or aggressive within the meaning of the CPRs 2008. All descriptions, representations, and pricing of artwork and advisory services will be accurate, clear, and not misleading. Maddox Gallery will not omit or hide material information that a consumer needs to make an informed purchasing decision.

All pricing displayed by Maddox Gallery will include VAT where applicable and will clearly state where additional charges (such as delivery, framing, or insurance) may apply. Maddox Gallery will ensure that all mandatory pre-contractual information required by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015 is provided to consumers before they are bound by a contract.

14. Our responsibility for loss or damage suffered by you

Whether you are a consumer or a business user:

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation. 

If you are a business user:

We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
